Patna High Court CWJC No.3093 of 2021(2) dt.05-02-2021 2/3 representation dated 20.06.2019 for Voluntary Retirement on account of ailment.

Learned counsel for the petitioner submits that petitioner has joined the service on 15.07.1981 and is due to retire in 2023. The petitioner has crossed 57 years of age and as such entitled to the Voluntary Retirement.

Considering the aforesaid facts, the writ petition is disposed off with a direction to the District Magistrate, Jamui (respondent No.4) to examine the claim of the petitioner in the light of the Bihar Service Code and pass appropriate orders on the claim of the petitioner for Voluntary Retirement as the petitioner is suffering from paralysis and is unable to perform his official duties. On filing a representation by the petitioner within a period of one month from today, the same shall be considered and disposed off at the earliest, preferably within a period of three months from the date of filing of such representation.
