1. Nawab Khan S/o Seraj Khan , R/o Vill.- Simraur, P.S.- Neemchak Bathani, District- Gaya.
.... .... Petitioner/s
Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Kunwar Narayan Jamuar For the Opposite Party/s : Mr. Smt. Asha Devi ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-08-2018 Heard both sides.
The petitioner apprehends his arrest in Neemchak Bathani P.S. case No. 15 of 2013 for the offences punishable under Sections 147, 148, 149, 323, 295 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that a prayer for anticipatory bail of the petitioner was allowed vide order dated 12.10.2015 passed in Cr. Misc. No. 28702 of 2015 but the petitioner could not surrender in time. The petitioner again moved for grant of anticipatory bail in this Court. It appears that the petitioner was granted anticipatory bail vide order dated 12.10.2015 passed in Cr. Misc. No. 28702 of 2015 but the petitioner neither surrendered in the
Patna High Court Cr.Misc. No.25095 of 2018 (2) dt.08-08-2018 2/2 Court below nor filed any petition for extension of time and after about three years the petitioner again filed petition for grant of anticipatory bail.
Taking into consideration the facts that the petitioner himself remained negligent and did not surrender in the Court below for about three years in spite of the fact that he was granted anticipatory bail by this Court, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/Rajan U T
