JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioner and three others are named in the first information report with specific accusation that they assaulted the deceased on 17.10.2015 and on account of the aforesaid assault, deceased died on 30.10.2015.
Learned counsel for the petitioner submits that the informant has admitted that after the alleged occurrence, he took the deceased to hospital but on the very next day of the alleged occurrence he returned with his father and again on 28.10.2015 the
Patna High Court Cr.Misc. No.33895 of 2016 (3) dt.22-10-2016 2/2 condition of his father started deteriorating and thereafter he took him to PMCH where he died on 30.10.2015. It is further submitted that having similar allegation, co-accused, Kameshwar Das and Karu Das have already been granted privilege of bail by a coordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Gayatri Kumari, Judicial Magistrate 1st Class, Patna in connection with Parsa Bazar P.S. Case No. 183 of 2015.
