Petitioner prays for bail in connection with Birpur P.S.Case No. 1 of 2018 registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons, including the petitioner is of firing and causing injury on the neck of the wife of informant and due to which she succumbed to the injuries. Petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that FIR itself shows that allegation of firing is against Jogi Mahto and Dheeraj Mahto and no specific allegation has been attributed against him and he is in custody since 29.5.2018.

Patna High Court Cr.Misc. No.55010 of 2018 (2) dt.10-10-2018 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides and in the facts and circumstances and there is no overt act has been alleged against the petitioner, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Birpur P.S.Case No. 1 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
