JUSTICE SANJAY PRIYA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and State. This application has been filed for modification of the order dated 21.08.2017 passed by this Court in Cr. Misc. 15749 of 2017.
It has been submitted that petitioner was granted provisional anticipatory bail for a period of six months with direction to send the disputed signature to FSL for its verification. In compliance of the aforesaid order, the learned Magistrate has sent the document to FSL Patna on 6.9.2017 but report has not been received by the court below till date. It has further been submitted that office of the FSL has requested the learned Magistrate to send some more specimen signature of the opposite party No. 2 in order to test the same. Therefore, there is no laches
Patna High Court Cr.Misc. No.50735 of 2018 (2) dt.29-08-2018 2/2 on the part of the petitioner since the delay has occurred due to circumstances beyond the control of the petitioner. Therefore, the provisional anticipatory bail granted to the petitioner may be extended for further six months.
In such circumstances, the provisional anticipatory bail granted to the petitioner vide order dated 21.08.2017 passed in Cr. Misc. 15749 of 2017 is extended for further six months from the date of receipt/production of a copy of this order. In the meantime, the court below will ensure that the report is received from the FSL Patna. He will also send the compliance report to this Court.
Let this order be communicated to the Court of Sub Divisional Judicial Magistrate, Jamui, in connection with Complaint Case No. 1872-C of 2015.
