JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-10-2017 Heard learned counsels for the petitioner and respondentState. The petitioner is apprehending his arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offenses punishable under Sections 417, 406 and 304A of the IPC.

Initially, vide order dated 09.09.2014, a co-ordinate Bench of this Court granted provisional anticipatory bail to the petitioner. Subsequently, a co-ordinate Bench of this Court, vide order dated 13.11.2014 directed the matter to be listed after disposal of Cr. Misc. No. 29411 of 2014, wherein the petitioner had prayed for quashing the order of cognizance dated 20.08.2013, passed in Complaint Case No. 2572 (c) of 2012, by

Patna High Court Cr.Misc. No.23776 of 2014(6) dt.17-10-2017 2/2 learned Judicial Magistrate, 1st Class, Begusarai. The said quashing application has been allowed and the order of cognizance as well as consequential proceedings have been quashed vide order dated 01.09.2017, by a co-ordinate Bench of this Court. Hence, since the prosecution has been quashed, the petitioner has no apprehension of being arrested. Considering the aforesaid fact, the application is disposed of.
