JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Karja P.S. Case No. 123 of 2018 instituted for the offence under Sections 452, 326(A) and 307 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is aged about 68 years. He is not named in the written report. His name has come merely on suspicion.

Petitioner is said to be in custody since 28.06.2018. The Sessions Judge has mentioned in the impugned order that there is no direct evidence against the petitioner in the case diary. Petitioner was apprehended by the police on the ground that he was talking in the village for the dispute over Pathway and he along with other co-accused persons might have

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, West, Muzaffarpur, in connection with Karja P.S.
