JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Belganj P.S. Case No. 43 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation of recovery of 3 liters of wine from the house of the petitioner and it appears that he is an accused in two other cases of different types.
Submission of the learned counsel for the petitioner is that the house is joint and he has falsely been implicated in this case. It has further been submitted that other accused persons have been granted anticipatory bail by a co-ordinate bench of this court, which will be appear from the Annexure 2. Heard learned A.P.P. also, who has opposed the prayer for bail stating that recovery is from the house of the petitioner and they are having criminal antecedent, as this application is

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the court below and make prayer for regular bail, which will be considered by the learned court below, without being prejudiced by order of this Court and if possible to be disposed of on the same day.
