Mr. None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 10-09-2018 Heard Mr. Md. Anis Akhtar, learned counsel for the petitioners. None appeared on behalf of the State. Two petitioners, apprehending their arrest in Motihari Town P.S. Case No. 333 of 2018 registered for offence under Sections 420, 468, 469, 471, 472, 34 and 406 of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender.
Learned counsel for the petitioners, by way of referring to F.I.R. submits that it appears that there is dispute in between the parties in respect of claiming post of the Principlecum-Secretary of the college and for which the present F.I.R.
Patna High Court Cr.Misc. No.53750 of 2018(2) dt.10-09-2018 2/2 was lodged. He submits that the petitioners have been made accused on an accusation , as if, prior to lodging of the present case, both petitioners have committed some nuisance. Besides hearing, I have perused the material on record and after going through the same, I am of the opinion that it is a fit case for extending the privilege of the anticipatory bail. Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let both the petitioners, namely, (i) Md. Mansoor Ansari @ Mohammad Mansoor Ansari and (ii) Abu Mazoorah @ Abu Mahzoora be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two surities of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, District- East Champaran in connection with Motihari Town P.S. Case No. 333 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
