JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.
Petitioner is named in the first information report but subsequently, petitioner and one Manish Thakur were arrested in Town P.S. Case No.184 of 2016 and stolen motorcycle of the present case was also seized from their possession and, accordingly, they were made accused in Town P.S. Case No.184 of 2016 as well as in the present case.
Learned counsel appearing for the petitioner submits that petitioner has already been granted privilege of bail in Town P.S. Case No.184 of 2016 and, as a matter of fact, at the time of
Patna High Court Cr.Misc. No.30172 of 2016 (3) dt.04-10-2016 2/2 recovery of alleged so-called motorcycle, the said motorcycle was being driven by co-accused Manish Thakur.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Begusarai Town P.S. Case No.170 of 2016.
