2. This application has been filed for quashing the order dated 22.11.2022 passed by the J.M.F.C. Patna, Sadar in Complaint Case No. 7722 (C ) of 2022 by which the cognizance has been taken against the petitioners under Section 147, 323, 504, 506 and 34 of the IPC.
3. It has been vehemently argued by learned counsel for the petitioners; Shri Apurv Harsh that the allegations levelled against the petitioners are false and are civil in nature.
4. In my opinion, at this stage, the allegations make
Patna High Court CR. MISC. No.52972 of 2023(6) dt.02-07-2024 2/2 out a case as alleged by the complainant.
5. In the facts of the case when the allegations make out a case, the complaint cannot be quashed only because of the submission that the dispute is of civil nature.
6. This application is dismissed with the liberty to the petitioner to raise all the grounds at the stage of framing of charge.
