JUSTICE PRABHAT KUMAR JHA ORAL ORDER 06-08-2015 Heard both sides The petitioner seeks bail in a case under Sections 302/34 of the Indian Penal Code and Sections 3 and 4 of the Dayan Act.

The petitioner and Ram Chandra Uraon are alleged to have tied the neck of Mandeo Uraon (the father of the informant) and dragged him till his death. It is submitted that the petitioner is in jail since 22.07.2012. The prayer for bail of Ram Chandra Urao has already been rejected.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on bail in Nauhatta P.S. Case No. 20 of 2012, corresponding to Sessions Trial No. 457 of 2012. Accordingly, the same is rejected.

The Superintendent of Police, Sasaram is directed to procure the attendance of the witnesses in the aforementioned case so that the trial must be concluded within the above stipulated period of six months.

Learned trial court is directed to hold the trial on dayto-day basis as the petitioner is in jail for last more than three years and conclude the same positively within six months. (Prabhat Kumar Jha, J) Dilip/- U T
