Petitioner seeks bail in a case registered under sections 395 and 397 of the Indian Penal Code.
Petitioner is not named in the first information report but in course of investigation, some witnesses stated that culprits were taking the names of each others and in the aforesaid conversation, name of the petitioner came. Moreover, petitioner and other accused were arrested in connection with Ariyari P.S. Case no. 173/2014 and one Hiwa truck was seized from their possession but seized Hiwa truck was not looted property of the present case. Subsequently, petitioner and his associates made confessional statement accepting their guilt in the present case and on the basis of the aforesaid fact, I.O submitted charge sheet against the petitioner and others. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge VI, Bhagalpur in Sessions Trial no. 63/2016 arising out of Kahalgaon P.S. Case no. 570/2014.
