JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-04-2019 A counter affidavit has been filed on behalf of the respondents today. Three cheques bearing No. 128639 dated 16.04.2019, Rs. 26,374/-, Cheque No. 128640 dated 16.04.2019 Rs. 13,859 and Cheque No. 128641 dated 16.04.2019 Rs. 1,27,413/- respectively have been produced in the Court. Learned counsel for the Insurance Company submits that pursuant to the last order passed by this Court, the calculation chart as per Annexure '1' and other details have been furnished in the affidavit.

Mr. Chandra Kant, learned counsel for the petitioner

Patna High Court CWJC No.11272 of 2017(10) dt.22-04-2019 2/2 submits at this stage that the petitioner has some more issues with regard to other three policies. As this Court finds that there are some disputed question of facts with respect to other three policies which may require adjudication after taking some evidence, it would not be proper for this Court to delve in those issues as a fact finding Court.

The petitioner, if so advised, will have liberty to raise her claim with regard to those policies in respect of which payments have not been made to the petitioner and disputes have been raised.

This writ application is disposed off with the liberty aforesaid.

The three cheques are being handed over to Mr. Chandra Kant, learned counsel for the petitioner for onwards submission to the petitioner. A receipt showing handing over those cheques will be filed in registry of the Court within one week which will be kept on record.
