The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A and 376/34 of the Indian Penal Code.

The accusation is of kidnapping minor daughter of the informant by co-accused Rajiv Kumar. In 164 Cr.P.C. statement the victim alleged that she was kidnapped by co-accused Rajiv who established forceful physical relationship and subsequently took the victim to this petitioner's house who happens to be parental uncle of coaccused Rajiv. It is submitted by counsel for the petitioner that when Rajiv came with the victim he informed the Panchayat

Patna High Court Cr.Misc. No.20722 of 2015 (02) dt.05-05-2015 2/2 Mukhiya and in 164 Cr.P.C. statement the victim has not alleged anything bad against the petitioner.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against Rajiv, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 24 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
