JUSTICE SHIVAJI PANDEY ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking regular bail in connection with Nawkothi P.S. Case No.48 of 2016, registered for the offence punishable under Sections 452, 386, 504, 506/34 of the Indian Penal Code.

The petitioner has a criminal history, which has been mentioned in paragraph No.3 of the application including the case related to extortion and murder. On the date of incident, the petitioner and one Ajay Singh went to the house of the informant and tried to coerce the informant to withdraw the candidature of Prakhand Pramukh as they wanted to get elected the wife of Munna Singh. As per the allegation, the informant

Patna High Court Cr.Misc. No.32434 of 2016 (2) dt.16-08-2016 2/2 had to give an extortion amount of Rs.10,000/- including his golden chain to them. Further allegation has been made that they said the informant to withdraw the name of his wife from the contest otherwise he will be killed. Ultimately, the wife of Munna Singh has been elected as Prakhand Pramukh. Learned counsel for the petitioner submits that the petitioner is the victim of Ajay Singh. He further submits that under the political pressure this case has been lodged against him.

Learned counsel for the other side submits that in the present case Ajay Singh neither informant nor witness. Looking to the nature of allegation and the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the stipulated period, the petitioner will have a liberty to renew his prayer for bail.
