The sole petitioner who is in custody since 25.5.2016 in Barauni Rail P.S. Case No. 42 of 2016 registered for the offence under section 379 of the Indian Penal Code , has prayed for grant of bail.

By way of referring to the F.I.R. it was submitted by learned counsel for the petitioner that occurrence alleged had taken place on 10.5.2016 whereas in this case F.I.R. was lodged on 23.5.2016 and only after two days petitioner was arrested in this case on the basis of confession of one of the co- accused. Considering the nature of accusation and period of custody, let the petitioner Sanjay Rajak be enlarged on bail on
