Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but there is only allegation against the petitioner that he assaulted the informant causing fracture injury on his hand. However, the first information report reflects that the alleged occurrence took place on account of land dispute and it has specifically been mentioned in the supplementary affidavit that the co-accused Akhilesh Yadav has lodged counter case, i.e., Madhubani Town P.S.Case No. 123 of 2016 against the prosecution party.
