The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 354/34 of the Indian Penal Code.
It is alleged that the this petitioner along with other entered into the house of the complainant while she was sleeping and tried to outrage her modesty but on alarm being raised they flee away after snatching silver chain from the neck of the complainant.
It is submitted by learned counsel for the petitioner that for the occurrence of 14.12.2013 the complaint was filed on
Patna High Court Cr.Misc. No.19887 of 2015 (2) dt.29-04-2015 2/2 16.12.2013. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 2327 of 2013, pending before the learned Judicial Magistrate, 1st Class, Banka.
With the above observation, this application is, accordingly, disposed off.
