Petitioner is accused in connection with Sherghati P.S. Case No. 65 of 2016 registered under Sections 399 and 402 of the I.P.C. and 25(1-b)(a) and 26 and 35 of the Arms Act. The accusation is that on receiving the secret information about gathering of 6 to 7 persons in suspicious condition in the village Gopalpur, the Police reached there, they started to flee away but four persons, including the petitioner were apprehended, who disclosed the name of three other associates. On search, the petitioner was found in possession of one country made pistol and one life cartridge whereas Pradip was found in possession of one thernet and life cartridge and Mritunjay Kumar

Patna High Court Cr.Misc. No.28039 of 2016 (2) dt.15-07-2016 2/2 and Sikandar Khan were found in possession of dragger. Submission of learned counsel for the petitioner submits that petitioner has falsely been implicated in this case showing the recovery of one country made pistol and one life cartridge. Further it is submitted that while the petitioner is accused in one another case i.e. Magadh University P.S. Case No. 105 of 2013 but he is on bail in that case. Petitioner is in custody since 11.02.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., (Sherghati), Gaya in connection with Sherghati P.S. Case No.65 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner.
