JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 The petitioner is languishing in custody since 25.05.2016 in a case registered for the offences punishable under Sections 20(ii)b/22(b) of the Narcotic Drugs & Psychotropic Substances Act.

From the possession of the petitioner 5 kg and 240 grams of ganja were recovered.

It is submitted by learned counsel for the petitioner that recovery is between small and commercial quantity. It is further submitted that though the petitioner is accused in Special Case No. 01 of 2012(arising out of Khagaria Rail P.S. Case No. 18 of 2012 registered under Sections 20 and 22 of the Narcotic Drugs & Psychotropic Substances Act but he is on bail in that case.

Mr. J. N. Thakur, learned A.P.P does not controvert the quantity of recovery.

Patna High Court Cr.Misc. No.36091 of 2016 (3) dt.28-10-2016 2/2 Considering the quantity of recovery between small and commercial and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur in connection with G.R. Case No. 45 of 2016, arising out of Bhagalpur Rail P.S. Case No. 45 of 2016. Learned Court below will be at liberty to cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
