JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case registered under Section 304B and 120(B) of the Indian Penal Code in which Section 201 IPC was added later on. The prosecution case, in short, is that the accused persons assaulted, tortured and thereafter caused death of the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner is the brother of the father-in-law of the deceased. He is separate in mess and property from the husband

Patna High Court Cr.Misc. No.52274 of 2018(2) dt.06-09-2018 2/2 of the deceased. The husband of the deceased is in custody. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Sasaram, Rohtas in connection with Shivsagar (Baddi) P.S. Case No. 159 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
