The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 448, 427, 379, 379 & 504 of the Indian Penal Code and 26 and 27 of the Arms Act.

The prosecution case in short is that the neighbour of the informant was assaulted by the accused persons due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.4.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner is said to have given blow with iron rod but the

There is a case and counter case between the parties. The main allegation is against the coaccused Rajpal Yadav. He is said to have fired which corroborates with the injury report.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -1, Nawada in connection with Akbarpur P.S. Case No. 119/2019.
