JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 09-10-2017 Heard Mr. Sanjay Kumar Ghosarvey, learned counsel for the petitioner and leaned AC to AAG-4. The present Writ application has been filed for a direction to the respondent authorities to conclude the proceeding of Settlement Case No.4/2006-07.

It is submitted by learned counsel for the petitioner that the petitioner is a retired Army Personnel while in pursuance to the government policy for settlement of Gairmajarua land to the Army Personnel the recommendation was made for settlement of the land in favour of the petitioner. The petitioner made an application for settlement of the land appertaining to Plot No. 4155, Thana No. 396, Khata No. 169, measuring an area of 2

Patna High Court CWJC No.6306 of 2015 (2) dt.09-10-2017 2/2 katha 5 dhurs situated in Mauza - Bishanpur, Chaturbhuj in the district of Begusarai. Consequently Settlement Case No. 4/200607 was initiated but till date the settlement proceeding has not been concluded, on one pretext or the other, though, the petitioner has retired from service on 30.11.2013.

It is submitted by learned AC to AAG-4 that, at present, he is not having any instruction. Since the present application has been filed on 21.04.2015 but till date no counter affidavit has been filed, this Court is not inclined to adjourn the matter any further.

It is jointly submitted that the present Writ application may be disposed of with a direction to the respondent authorities to conclude the proceeding within a time frame. In the circumstances, this Writ application is disposed of with a direction to the respondent authorities to conclude the proceeding of Settlement Case No. 4/2006-07 within a period of four months, after giving due opportunity of hearing to all affected persons, in accordance with law.
