JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, as soon as the informant reached the bank premises and was riding the stairs of the bank to deposit a sum of Rs.13,38,890/-, some unknown miscreants snatched his cash and ran way from the bank premises. While committing robbery, miscreants made indiscriminate firing. Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in his self confessional statement made in Kotwali PS case No. 221/2020. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade

Patna High Court CR. MISC. No.62171 of 2021(3) dt.24-02-2022 2/2 has not been carried out till date. Petitioner is in custody since 29.01.2021 and investigation in this case is complete . Learned counsel appearing for the State opposes the prayer for bail and submits that the petitioner has got criminal antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Jehanabad in Makhdumpur Police Station Case No. 45/2020.
