Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 34,120(B) of the Indian Penal Code and 27 of Arms Act.
Submission is that the petitioner is not named in the FIR of the occurrence of murder. Name of the petitioner surfaced in the confessional statement of co-accused-Rohit Kumar Yadav, wherein he simply stated that the petitioner was involved in this case. He further submits that some other co-accused have been allowed bail in this case by different Coordinate Benches of this Court.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.47152 of 2018 (2) dt.09-08-2018 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ladaniya Police Station Case No.163 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
