2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 304(2) of the B.N.S.

3. The case of the prosecution is that, on 01.10.2024, the informant along with his wife was returning from a morning walk. In the meantime, two unknown miscreants intercepted them and snatched golden chain from the neck of his wife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It has further been submitted that the petitioner is not named in the FIR and his

It has also submitted that nothing has been recovered from the conscious possession of the petitioner. It has next submitted that the petitioner has fourteen criminal antecedents of similar nature of offence and merely on the basis of the same, his name has been framed in this case. Moreover, the petitioner is languishing in judicial custody since 18.01.2025.

5. Learned APP appearing for the state has conceded that even in the CCTV footage this petitioner was not identified.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sachivalaya P.S. Case No. 135 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IInd Patna/concerned trial court, with condition(s):- (i) the petitioner shall cooperate in the trial and shall remain physically present on each and every dated fixed at the trial. In case of default in such appearance on two consecutive dates without any plausible reason, the learned trial court will have liberty to cancel the bail bonds of the petitioner.

Patna High Court CR. MISC. No.51996 of 2025(3) dt.05-12-2025 3/3 (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bonds.
