IVth, Gopalganj has refused an application under Section 311 Cr.P.C. in Sessions Trial No.322 of 2011 arising out of Uchkagaon P.S. case No.158 of 2010. Having gone through the fact that the Petitioner did not cross examine the witness for whatever reason and has sought a recall without any justification, I am not inclined to interfere in the matter. The application stands dismissed.
