JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

The statement of the victim has been recorded under Section 164 of the Criminal Procedure Code, which has been brought on record by way of Annexure-2 to this present application.

Learned counsel appearing on behalf of the petitioners appears to be right in his submission that the said statement does not refer to involvement of these petitioners in commission of the offence, who are mother

Patna High Court Cr.Misc. No.19215 of 2015 (2) dt.25-06-2015 2/2 and father of the co-accused, namely, Prem Kumar, alongwith whom the victim had gone.

In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Birpur P.S. Case No. 12 of 2015, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
