The petitioner seeks bail in a case registered for the offences punishable under Sections 386, 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that Ajit Kumar and his two accomplice including the petitioner were demanding Gutka on credit from the informant.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.62155 of 2021(3) dt.25-04-2022 2/2 from perusal of the allegation as alleged in the F.I.R., it would manifest that petitioner is not alleged to be the assailant. The allegation of firing is on Ajit Kumar and as far as this petitioner is concerned, it is alleged that he had already accompanied. The learned counsel submits that petitioner was completely unaware that for such trivial issue, Ajit Kumar was in turn in such a manner.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and is not the assailant, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tribeniganj P. S. Case No.41 of 2021.

The application stands allowed.
