JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 09.11.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Learned Addl. Chief Judicial Magistrate, Sherghati vide letter no. 916 dated 21.10.2016 has reported that case of the petitioner has already been committed to the court of sessions. Petitioner happens to be husband of the deceased and is languishing in jail custody since 6.4.2015 but now, the case of the petitioner has already been committed to the court of sessions. Therefore, again, I am not inclined to release the petitioner on bail and his prayer for bail in connection with Sherghati P.S. case no. 88/2015 stands rejected.

However, learned Sessions Court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of a copy of this order, failing which petitioner may renew his prayer for

Patna High Court Cr.Misc. No.35137 of 2016 (3) dt.09-11-2016 bail before the learned trial court itself.
