02. In the present case, the petitioner seeks bail in connection with Rajnagar P.S. Case No. 493 of 2025 registered for the alleged offences under Sections 126(2), 115(2), 308(4), 351(2), 352, 3(5) of BNS and Sections 25(9)/27 of the Arms Act.

03. As per prosecution case, the petitioner and two other co-accused persons tried to rob a petrol pump and they forced the attendants to fill up the tank of their vehicle without making any payment. They also threatened the employees of the petrol pump that if any complaint was made, they would be shot dead.

04. Learned counsel for the petitioner submits that the

The FIR has been lodged after delay of six days without any satisfactory explanation. On the alleged date of occurrence, there was hot talk and scuffle between the informant, his staff and the petitioner and taking advantage of this fact, the petitioner has been falsely implicated in the present case. Learned counsel further submits that the petitioner is having antecedent of four cases and he is on bail in all the cases. The petitioner is in custody since 08.01.2026 and charge sheet has been submitted.

05. Learned APP vehemently opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner is habitual offender as he is accused in four cases of very serious nature.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Madhubani/concerned Court in connection with Rajnagar P.S.

Patna High Court CR. MISC. No.51326 of 2026(2) dt.29-07-2026 3/3 Case No. 493 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.

(iv) The petitioner shall appear before the concerned police station on every fortnight to mark his attendance.
