This application for anticipatory bail arises out of Chakia P.S. Case No. 256 of 2018, S.Tr. No. 127 of 2019, disclosing the offence under Sections 363, 366-A of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners referring to the First Information Report and the statement of the victim recorded under Section 164 of the Cr.P.C. has contended that the main allegation, if any, is against co-accused Awadhesh Kumar, and these petitioners have been implicated because of their connection with co-accused Awadhesh Kumar. He has also submitted that, as a matter of
Patna High Court CR. MISC. No.49315 of 2019(2) dt.07-08-2019 2/2 fact, the alleged victim has performed marriage with the said Awadhesh Kumar but under family pressure she has given the statement under Section 164 of the Cr.P.C.
This application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned 1st Additional Sessions Judge, East Champaran, Motihari in Chakia P.S. Case No. 256 of 2018, S.Tr. No. 127 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
