JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Karpi P.S. Case No. 111 of 2014 registered for the offences punishable under Sections 387, 506 of the Indian Penal Code. Petitioner is not named in the first information report but his name surfaced when the investigating officer located the name of owner of mobile no. 7765051826.

The submission on behalf of the petitioner is that as a matter of fact, there was land dispute and the relative of the petitioner had gone to measure the disputed land which caused annoyance to the informant and thereafter, he lodged this false case.

Patna High Court Cr.Misc. No.21475 of 2015 (2) dt.07-07-2015 Petitioner does not have any criminal antecedent which is evident from perusal of para 3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.M. Tripathi, Judicial Magistrate 1st Class, Jehanabad in Karpi P.S. Case No. 111 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
