JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two persons were apprehended with stolen motorcycle and they disclosed the name of petitioner and others as their associates. Subsequently, the house of the petitioner was raided and one more stolen motorcycle is said to have been recovered from there.

Submission on behalf of the petitioner is that the seized motorcycle had been purchased by the petitioner from the aforesaid apprehended co-accused and, moreover, having similar allegation, one co-accused Binod Kumar Singh has already been grated privilege of bail by this Court, whereas petitioner is in jail

Patna High Court Cr.Misc. No.33985 of 2016 (2) dt.19-08-2016 2/2 custody since 03.04.2016 without having any criminal antecedent. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad ( Town) P.S.Case No. 110 of 2016.
