The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and (c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 20 litres of liquor and 200 litres of mixed solution was recovered from the bush of the roadside. The accused persons made an attempt to escape but some of them including the petitioner were caught. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. He has no concern with the seized liquor nor with the place of occurrence. No incriminating article has been recovered from his possession. He is in custody since 5.9.2021

Patna High Court CR. MISC. No.62012 of 2021(2) dt.12-04-2022 2/2 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for 7 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no.371 of 2021/PR. no.7 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
