====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 05.06.2019 in a case for the offence registered under Sections 401, 413, 414, 420, 467, 468 and 411/34 of the IPC. The prosecution story, in brief, is that on secret information, the police arrested co-accused Ravi Chaurasiya and recovered two Motorcycles from him. He did not produce any proper documents with regard to ownership of the said Motorcycles. During the course of investigation, Sonu Sah (petitioner) and co-accused Nitish Kumar were arrested and from them a Motorcycle was recovered which had a police monogram on its number plate. Thereafter, co-accused Abhishek Kumar and Upendra Kumar were arrested and recovered

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. The petitioner had no knowledge that the Motorcycle in question is stolen property. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 1st, Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 312 of 2019.
