The learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application against petitioner no. 1 (Sadik Ali).

Permission is accorded.

The petitioner nos. 2 to 5 apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 447, 448, 504, 506 and 34 of the Indian

Patna High Court CR. MISC. No.62224 of 2021(2) dt.13-07-2022 2/3 Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and allegation in the FIR is of assaulting the informant, his sons and brother by the accused persons.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR it would manifest that no specific allegation alleging any overt act has been alleged against the petitioners, it is next submitted that specific allegation of assault is alleged against the named accused persons as detailed in the FIR.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos. 2 to 5, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bausi P.S. Case No. 84 of 2021 subject to the conditions as laid down under Section
