====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 29-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.

2. In the instant petition, petitioner has prayed for following reliefs:

"1. That this writ application is being filed for issuance of writ nature of mandamus for direction to the respondent consider the application dated 02.11.2020 filed by the petitioner and further issue direction to respondents consider the application of the petitioner and is sued selection letter on the post of peon in pursuance of the advertisement No. 01/2013 and further give other legal consequential benefit to the petitioner."

3. Learned counsel for the petitioner has not pointed out as to how and in what manner he has vested right in seeking the

Patna High Court CWJC No.3291 of 2021 dt.29-01-2022 2/2 aforesaid relief. In other words, he has not furnished the select list or questioned the validity of selection and appointment of any third person. In the absence of these factual aspects, the petitioner is not entitled to the aforesaid relief.

4. Accordingly, the instant petition stands dismissed reserving liberty to the petitioner to file a fresh petition with the above material information.
