Petitioner seeks regular bail in a case registered for the offence punishable under Section 37 of the Bihar Prohibition and Excise Act and section 379 and other sections of the Indian Penal Code.
Petitioner was apprehended in drunken state while committing mischief and loot.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation and no specific overt act has been alleged against the petitioner. Petitioner is in custody since 31.8.2021.

Learned counsel appearing for the State opposes the prayer for bail and submits that the petitioner has got identical criminal antecedent.
Considering the rival submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Shahpar Patori Police Station Case No. 329/2021 , once the charge is framed in the case.
