JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Daudnagar P.S. Case No. 142 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act.
Prosecution story is that police received an information that liquor traders were sitting near Brahma Asthan and reached there and two accused were succeeded in fleeing away and two accused persons were arrested, who disclosed the name of the petitioner. It is also alleged that 6.4 litres of liquor was recovered from there .
Submission of learned counsel for the petitioner is that except disclosure made by co-accused there is nothing against him and he has no criminal antecedent and he has falsely

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that name of the petitioner was taken by co-accused. However, he conceded to the fact that nothing has been recovered from his possession. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge, Excise, Aurangabad, in connection with Daudnagar P.S. Case No. 142 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
