JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 354A, 354B of the Indian Penal Code.

As per the prosecution case, this petitioner was apprehended while committing sexual assault on the minor daughter of the informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No such occurrence,as alleged in the FIR, has ever taken place. Petitioner claims clean antecedent and is in custody since 17.07.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that there is direct and specific

No.62244 of 2021(2) dt.17-02-2022 2/2 allegation against this petitioner of committing sexual assault with the victim and the victim in her statement under Section 164 of the Cr. P. C. also supported the prosecution case. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
