The petitioners have prayed for bail in the present case registered for the offence punishable under sections 120(B) of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act.

Prosecution case relates to recovery of 6,273 litres of IMFL from a truck of which petitioner no. 1 was driver and petitioner no. 2 was khalasi and both were apprehended on spot. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. Petitioners have no concern with the alleged

Patna High Court CR. MISC. No.58532 of 2023(3) dt.03-10-2023 2/2 recovery. Petitioners have no criminal antecedent and are languishing in judicial custody since 12.4.2023. Learned APP appearing for the State has opposed the prayer of Bail.

Petitioner no. 1 is directed to deposit Rs. 20,000/- (Rs. twenty thousand only) in the concerned DLSA.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Special Court Excise, Danapur in connection with Rani Talab P.S. Case No. 107 of 2023.

The bail bonds of the petitioner no. 1 shall be accepted by the learned court below on showing receipt of deposit of Rs. 20,000/- (twenty thousand only) by the petitioner in the account of concerned DLSA.
