This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 363, 365, 341 and 323/34 of the Indian Penal Code. It is submitted that petitioner has got no criminal antecedent. Learned counsel appearing on behalf of the petitioner has drawn my attention towards Annexure-3 of the present application. He submits that because of political rivalry and village politics, the petitioner was named by the victim in his statement recorded under Section 164 of the Cr.P.C., levelling the allegation of kidnapping.

In view of the submission as above, and also taking

Patna High Court Cr.Misc. No.19160 of 2015 (2) dt.25-06-2015 2/2 into account the fact that the petitioner has got no criminal antecedent, let the petitioner abovenamed, in the event of his arrest/surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi P.S. Case No. 18 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
