Petitioner seeks bail in Dumariya P.S. Case No.37 of 2013 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 17 of the CLA Act.

Counsel for the petitioner submits that petitioner has clean antecedents.

In the written report, there is general and omnibus allegation against the petitioner. Petitioner is in custody since 29.06.2018.

It has been submitted that other co-accused have been granted bail by co-ordinate Benches of this Court by order

Patna High Court Cr.Misc. No.51191 of 2018 (2) dt.25-09-2018 2/2 dated 23.04.2014 passed in Cr. Misc.No.7596 of 2014, order dated 29.01.2015 passed in Cr. Misc.No.3560 of 2015, order dated 10.08.2015 passed in Cr. Misc.No.32837 of 2015 and order dated 05.10.2015 passed in Cr. Misc.No.39304 of 2015. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Sherghati, Gaya, in connection with Dumariya P.S. Case No.37 of 2013, subject to the condition that both the bailors shall be close relative of the petitioner.
