The petitioner seeks bail in a case registered for the offence punishable under Sections 30 (a), and 38 of the Bihar Prohibition and Excise Act, 2016.

3071.52 liters of foreign liquor is said to have been recovered from the container and the petitioner is said to be trafficker of the liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern either with the seized liquor or the vehicle in question or any trade of

The identity and genuineness of source of information has not been mentioned in the written report. There is violation of Section 100 Cr.P.C. He has been languishing in custody since 18.07.2018. Similarly situated co-accused Pawan Kumar Singh @ Pawan Kr. Singh has been enlarged on anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.17574 of 2018 vide order dated 29.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Excise P.S. Case No. 05 of 2018.
