BEFORE THE LOK ADALAT HELD AT HIGH COURT PATNA MJC No. 593 of 2014 Petitioner :Sahodara Devi Respondent :The State of Bihar & Ors Present:- Member(Judicial) :Mr. Justice Mohit Kumar Shah Member(Legal Profession) : Mr. Aditya Prakash Sahay, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: Heard the learned counsel appearing for the parties. The parties are in agreement that the order dated 7.9.2012 passed in C.W.J.C. No. 11297 of 2006 has been complied with in its true and spirit, as it is apparent from the various show causes and supplementary show cause filed by the Accountant General, Bihar, Patna before the Lok Adalat.
According to the supplementary show cause filed by the Accountant General, required pay slip authority with reference to leave encashment of the petitioner has been issued. It is further submitted that since the wife of the petitioner was enjoying family pension etc. from the office of the Accountant General, Ranchi, the Accountant General, Bihar, Patna, by a letter dated 15.11.2017 has also issued a pay slip and authority (Revision) to the Accountant General, Jharkhand for the aforesaid lifetime arrear of pension etc. In fact, the office of the Accountant General (A & E), Jharkhand, Ranchi by an order dated 29.11.2017 has also revised the arrear of pension/ family pension etc. to the petitioner herein. It is further submitted that the petitioner may approach the District Treasury Officer, Ranchi and she would be paid the dues.
The learned counsel for the Accountant General submits that in fact, a direction has been issued to the Accountant General, Ranchi to pay the arrears as well as revised family pension etc. from time to time. Heard the learned counsel for both the parties and both parties are in agreement that nothing survives in the present case . It is directed that the aforesaid payment be made to the petitioner within three weeks. In view of the aforesaid, the present application is disposed of. The parties are informed that the court fee, if any, paid by any of them shall be refunded.
