Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Bibhutipur P.S. Case No. 138 of 2022 registered for offence punishable under sections 341, 323, 324, 504, 506, 307/34 of the Indian Penal Code.

The learned counsel for the petitioners has submitted that there is allegation on the petitioners that at the order of petitioner no. 1, petitioner no. 2 assaulted Nand Kumar Singh,

Patna High Court CR. MISC. No.51515 of 2022(2) dt.19-01-2023 2/2 who sustained grievous injuries, but petitioner no. 2 has also sustained grievous injury and petitioner no. 1 has sustained simple injuries. She has submitted further that there is case and counter case and the informant in counter case has been granted anticipatory bail.

Considering the fact that the petitioners have also sustained injuries amongst which one is grievous in nature, let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Samastipur in connection with Bibhutipur P.S. Case No. 138 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
