JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that 17 FIR named accused persons including the petitioners came variously armed when co-accused Pradeep Paswan fired first shot causing injury upon the chest of the informant's husband, thereafter, co-accused Srikant and Surendra dragged the husband of the informant outside and fired at the victim leading to his death. It is alleged against the petitioners that they disposed of the dead body. It is submitted by learned counsel for the petitioners that at best, the offence under Section 201 IPC is made out and the

Patna High Court Cr.Misc. No.9757 of 2015 (2) dt.22-04-2015 2/2 petitioners and other similarly situated accused persons have been granted regular bail by this Court vide Cr. Misc. Nos. 4679 of 2013, 26084 of 2013, 31707 of 2013, 31787 of 2013 and 43747 of 2013.

Considering the fact that accusation of assault is not against the petitioners and other similarly situated accused persons have been granted regular bail, this Court sees reasonable ground for consideration of regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Paliganj P.S. Case No. 160 of 2012 pending in the court of learned ADJ-II, Danapur, Patna. Accordingly, the application is disposed of.
