JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47/51 of the Excise Act.

Petitioner is in jail custody since 21.04.2016 on the accusation that seeing police party he threw bag but he was caught by the police and on being searched of the aforesaid bag it was found that 35 pieces of Nepali liquor kept in plastic bottles were recovered from the said bag.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.30554 of 2016 (2) dt.05-08-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Kanhauli P.S. Case No. 40 of 2016.
